Hello guys!
I want to share with you in this post our experience in The Vijitt Resort.

The Vijitt Resort exceeded my expectations in every respect. From the moment we arrived, we were met with warm smiles, greeted by everyone and, generally, made to feel special. The villas are beautifully appointed. We appreciated the fact we didn’t hear anyone else and it felt very private. The toiletries smelled wonderfully of lemongrass and I was glad

Breakfast was very good and I really enjoyed the different Thai dish available every morning. I had my first introduction to coconut jam and now I’m hooked! We were looked after by a lovely lady at breakfast and I’d just like to say that she made breakfast even more enjoyable!

The pool area is beautiful. The infinity pool, the palm trees, the loungers at the pool and on the beach, the hammock, all worked together to make it a great place to unwind. It never felt crowded. Many relaxing hours were spent there. The infinity pool has great views and a top spot to relax having a cocktail and watch the day go by.

The food is delicious. If you want a getaway place with your partner, this place is perfect.

Having a free shuttle service was very helpful, We availed ourselves of the in-room dining and enjoyed the food served. If you are so inclined, there are local restaurants an easy walk from the resort. We went to one just across the road from the resort and had a lovely meal there.

If you want peace, quiet, good food and pampering the Vijitt will be perfect, we couldn’t fault any aspect of our stay and will definitely be going back.

Términos y condiciones

1. INFORMACIÓN GENERAL
Las presentes condiciones de uso (las “Condiciones de Uso”) regulan el acceso y la utilización del sitio web alojado bajo el nombre de dominio www.trendactually.es (el “Sitio Web”) y bajo cualquiera de los subdominios o páginas web dependientes del mismo, así como los contenidos y servicios que el titular del Sitio Web pone a disposición de sus usuarios (los “Usuarios”) y establecen junto con la Política de Privacidad y Cookies, relativas a la gestión de datos de carácter personal de los Usuarios, los términos y condiciones por los que se rige el Sitio Web.
En cumplimiento del artículo 10 de la Ley 34/2002, de 11 de julio, de Servicios de la Sociedad de la Información y del Comercio Electrónico, se exponen los siguientes datos identificativos del titular del Sitio Web:
www.trendactually.es es una web propiedad de Dña. María Tavera Sánchez, que ejerce como profesional autónoma en el desarrollo de su actividad económica.
2. OBJETO DEL CONTRATO
Las presentes Condiciones de Uso conforman el contrato íntegro a través del cual se regulan las condiciones de compra de los productos puestos a disposición de los Usuarios por parte de Trend Actually en el Sitio Web (los “Productos”).
El acceso al Sitio Web o su uso por el Usuario, así como la compra de cualquier Producto, implica necesariamente, y sin reservas, el conocimiento y aceptación de las presentes Condiciones de Uso, por tanto, se recomienda que el Usuario las lea detenidamente cada vez que quiera comprar un Producto.
3. COMPRA DE PRODUCTOS
3.1. Cómo comprar Productos
Para realizar pedidos de Productos, el Usuario, deberá seguir el procedimiento de compra establecido en el Sitio Web, leer y aceptar las presentes Condiciones de Uso y seleccionar “Finalizar y Pagar” (el “Pedido”). A continuación, Trend Actually enviará un correo electrónico al Usuario confirmando que el Pedido ha sido aceptado (la “Confirmación de Envío”). El contrato entre el Usuario y Trend Actually quedará finalmente formalizado una vez que Trend Actually envíe al Usuario la Confirmación de Envío. Serán objeto del contrato únicamente aquellos Productos indicados en el Pedido.
3.2. Disponibilidad de Productos
Todos los Pedidos están sujetos a disponibilidad de los Productos. En el caso de que, una vez enviada la Confirmación de Envío, Trend Actually no pudiera disponer del Producto solicitado por cualquier circunstancia, se pondrá en contacto con el Usuario a la mayor brevedad posible comunicándole tal hecho. En tal caso, Trend Actually podrá:
(i) ofrecer al Usuario, sin aumento de precio, un producto de características y especificaciones similares al del inicialmente solicitado, siempre y cuando éstas sean acordes con las necesidades del Usuario; y/o
(ii) ofrecer al Usuario dejar sin efecto el Pedido solicitado reintegrándole el importe pagado por el mismo, en el plazo de (14) días hábiles.
3.3. Negativa a tramitar un Pedido
Aunque Trend Actually hará lo posible para tramitar siempre todos los Pedidos, puede haber circunstancias excepcionales que le obliguen a rechazar la tramitación de algún Pedido después de haber enviado la Confirmación de Envío, por lo que Trend Actually se reserva el derecho a hacerlo en cualquier momento, a su entera discreción.
Trend Actually se reserva el derecho de retirar cualquier Producto del Sitio Web en cualquier momento y de quitar o modificar cualquier material o contenido del mismo, no siendo responsable frente al Usuario o frente a cualquier tercero por el hecho de retirar cualquier Producto del Sitio Web, con independencia de si dicho Producto ha sido vendido o no, de quitar o modificar cualquier material o contenido del Sitio Web.
3.4. Garantía de los Productos
Todos los Productos contenidos en el Sitio Web son originales de Trend Actually. Todos ellos cuentan con una garantía de dos (2) años conforme a los criterios y condiciones descritas en el Real Decreto Legislativo, 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias.
Se entenderá que los Productos son conformes con las Condiciones de Uso siempre que cumplan con todos los requisitos que se expresan a continuación:
(i) Se ajusten a la descripción realizada por Trend Actually y posean las cualidades del Producto que Trend Actually haya presentado al Usuario en forma de muestra o modelo.
(ii) Sean aptos para los usos que ordinariamente destinen los Productos del mismo tipo.
(iii) Sean aptos para cualquier uso especial requerido por el Usuario cuando lo haya puesto en conocimiento de Trend Actually, siempre que Trend Actually haya admitido que el producto es apto para dicho uso.
(iv) Presenten la calidad y prestaciones habituales de un producto del mismo tipo que el Usuario pueda esperar, habida cuenta de la naturaleza del Producto.
En el supuesto de quedar probado que el Producto no se ajusta a las especificaciones establecidas, Trend Actually procederá, cuando corresponda, a la reparación, sustitución, rebaja del precio o resolución del contrato siendo tales gestiones gratuitas para el Usuario.
Trend Actually no es responsable de los daños en los Productos que puedan resultar de un mal uso de los mismos, así como de actos u omisiones del Usuario que no se ajusten a las especificaciones de cada Producto o de los daños causados por terceros que no estén vinculados a Trend Actually.
Trend Actually pone el mayor cuidado en la realización de la presentación y descripción de los Productos. Sin embargo, las fotografías de los Productos se presentan de manera ilustrativa. Para conocer las características precisas de cada Producto deberá comprobar los datos descriptivos correspondientes que acompañan a cada Producto.
3.5. Entrega de los Productos
Una vez enviada la Confirmación de Envío, los Productos se entregarán en la dirección indicada por el Usuario al realizar el Pedido en el plazo aproximado de entre 24-48H desde la salida de almacén del mismo.
Trend Actually no asume responsabilidad alguna cuando la entrega del Producto no llegue a realizarse como consecuencia de que los datos facilitados por el Usuario sean falsos, inexactos o incompletos o cuando la entrega no pueda efectuarse por causas ajenas a la empresa de envíos, asignada para tal efecto, como lo es la ausencia del Usuario o la retención del Producto en Aduanas.
Los plazos de entrega son aproximados, aunque Trend Actually intenta ajustarse a ellos.
3.6. Precio y pago de los Productos
Los precios aplicables a cada Producto serán los publicados en el Sitio Web en la fecha en la que el Usuario realice el Pedido. A pesar de que Trend Actually intenta asegurarse de que todos los precios que figuran en el Sitio Web son correctos, pueden producirse errores. En el caso de que Trend Actually descubra un error en el precio de alguno de los Productos que haya solicitado algún Usuario, le informará lo antes posible y le dará la opción de reconfirmar el Pedido al precio correcto o bien anularlo. Si Trend Actually no logra ponerse en contacto con el Usuario, el Pedido se considerará cancelado y se reembolsará al Usuario íntegramente las cantidades que hubiese abonado.
Trend Actually no estará obligado a suministrar al Usuario ningún Producto al precio inferior incorrecto (incluso aunque le Confirmación de Envío haya sido enviada) si el error en el precio es obvio e inequívoco y hubiera podido ser reconocido de forma razonable por el Usuario como precio incorrecto.
Los precios pueden cambiar en cualquier momento. No obstante, los posibles cambios no afectarán a los Productos con respecto a los que Trend Actually ya haya enviado la Confirmación de Envío.
a) Forma de pago
El Usuario podrá efectuar el pago mediante PayPal, en la que usted elige la forma de pago mediante tarjeta de crédito o débito, cuenta bancaria y saldo de PayPal. El cargo se efectuará en el momento en el que Trend Actually envíe la Confirmación de Envío al Usuario.
b) Impuesto sobre el Valor Añadido (IVA)
El tipo de IVA aplicable será el legalmente vigente en cada momento en función del producto concreto de que se trate.
4. DEVOLUCIONES Y CAMBIOS DE LOS PRODUCTOS
a) Derecho de desistimiento
Con arreglo a la normativa aplicable, en el caso de que el Usuario esté contratando como consumidor, podrá desistir del contrato (excepto en los supuestos establecidos por la legislación) y devolver o cambiar libremente los Productos entregados en cualquier momento dentro del plazo de catorce (14) días naturales desde la fecha de entrega del mismo (el “Plazo de Desistimiento”).
Una vez realizada la inspección pertinente del Producto devuelto al efecto de que se cumplan los requisitos establecidos en el apartado c) siguiente y en el supuesto de que el Usuario no decida realizar un cambio, Trend Actually reembolsará al Usuario el importe del Producto, salvo los gastos de envío que correrán a cargo del Usuario según lo incluido en la siguiente tabla:

Transcurrido el Plazo de Desistimiento, no se aceptarán cambios ni devoluciones de Productos. Únicamente se aceptarán cambios por aquellos Productos que hubieran podido resultar defectuosos de acuerdo con lo establecido en el apartado b) siguiente.
b) Devolución o sustitución de Productos defectuosos
En el caso de que el Usuario considere que el Producto no se ajusta a las especificaciones establecidas para dicho Producto, deberá ponerse en contacto con Trend Actually de manera inmediata a través de un correo electrónico a la dirección de contacto mariatavera@trendactually.es facilitando los datos del Producto, así como informando del defecto que tiene y de si opta por la devolución o la sustitución por un Producto idéntico.
El Usuario podrá devolver los Productos, en el lugar dónde se entregaron, a un mensajero que Trend Actually enviará o bien devolver el Producto por sus propios medios. Una vez realizada la inspección pertinente del Producto devuelto, Trend Actually enviará, dentro de un plazo razonable, un correo electrónico al Usuario informándole de si procede la devolución o sustitución del Producto (la “Decisión de Devolución o Sustitución”). En tal caso, la devolución o sustitución del Producto se efectuará lo antes posible y, en cualquier caso, dentro de los catorce (14) días naturales siguientes a la fecha de envío de la Decisión de Devolución o Sustitución.
En el caso de que proceda la devolución o sustitución, Trend Actually reembolsará íntegramente al Usuario el precio del Producto incluidos los gastos de envío. Si el Usuario ha optado por la sustitución, Trend Actually correrá con todos los gastos de envío.
c) Disposiciones comunes a las devoluciones
El Usuario deberá cumplir los siguientes requisitos para hacer uso del derecho de desistimiento, así como para poder realizar devoluciones y sustituciones de Productos:
(i) Para organizar la recogida del Producto, el Usuario deberá previamente ponerse en contacto con Trend Actually enviando un correo electrónico a la dirección de contacto mariatavera@trendactually.es
(ii) El Usuario podrá acreditar el ejercicio del derecho de desistimiento en cualquier forma admitida en derecho, considerándose en todo caso válidamente ejercitado mediante la devolución del Producto;
(iii) El Producto debe devolverse en las mismas condiciones que en las que se recibió. Trend Actually no reembolsará ninguna cantidad si el Producto ha sufrido algún daño, por lo que el Usuario deberá ser cuidadoso con el Producto mientras esté en su posesión; y
(iv) La devolución se efectuará en el mismo medio de pago que el Usuario utilizó para pagar el Producto.
5. USO DEL SITIO WEB
Los Usuarios se comprometen a utilizar el Sitio Web de conformidad con la ley, la moral, buenas costumbres generalmente aceptadas y el orden público vigente. Los Usuarios se obligan a abstenerse de utilizar el Sitio Web con fines o efectos ilícitos, contrarios a lo establecido en las presentes Condiciones de Uso, lesivos de los derechos e intereses de Trend Actually o de terceros o que de cualquier forma puedan dañar, o deteriorar la imagen o reputación de Trend Actually o impedir la normal utilización o disfrute de los productos y servicios que se ofrecen por parte de Trend Actually en el Sitio Web.
6. PROPIEDAD INTELECTUAL
Toda la información contenida en el Sitio Web, incluyendo su diseño gráfico y el código fuente, están protegidos por derechos de autor y demás derechos recogidos en el Real Decreto Legislativo 1/1996, de 12 de abril por el que se aprueba el Texto Refundido de la Ley de Propiedad Intelectual, y el resto de normas que regulan la Propiedad Intelectual.
Estos derechos pertenecen exclusivamente a Trend Actually, por lo tanto, queda expresamente prohibido cualquier acto de reproducción, distribución, transformación o comunicación pública, así como cualquier tipo de cesión, del todo o parte del contenido del Sitio Web, y en general cualquier acto de explotación de la totalidad o parte de los contenidos (imágenes, textos, diseño, índices, formas, etc.), así como de las bases de datos y del software necesario para la visualización o el funcionamiento de los mismos y de cualquier objeto que según la legislación vigente sea protegible por las normas de propiedad intelectual.
Los Usuarios no podrán en ningún caso explotar o servirse comercialmente, de forma directa o indirecta, total o parcial, de ninguno de los contenidos que conformen el Sitio Web sin la autorización previa y por escrito de Trend Actually.
La autorización para el uso de cualquier contenido del Sitio Web puede solicitarse a la dirección de correo electrónico mariatavera@trendactually.es Lo establecido en los párrafos anteriores no supondrá en ningún caso la asunción de responsabilidad por parte de Trend Actually sobre el contenido, ni podrá generar derecho a indemnización para Usuarios o terceros.
7. PROPIEDAD INDUSTRIAL
No podrán utilizarse las marcas, nombres comerciales, rótulos de establecimientos, denominaciones, logotipos, eslóganes o cualquier tipo de signo distintivo mostrado en el Sitio Web y perteneciente a Trend Actually, y muy en concreto, el denominativo “Trend Actually” y “ACT*like you think”, sin autorización previa y por escrito de Trend Actually
8. ENLACES A SITIOS WEB DE TERCEROS
Los enlaces contenidos en el Sitio Web, referidos a publicidad o a otro tipo de contenidos, y cuya titularidad o responsabilidad corresponda a terceros distintos a Trend Actually, no son responsabilidad de Trend Actually, quien en ningún caso se obliga a controlar ni a aprobar los servicios, contenidos, datos, archivos, productos y cualquier clase de material existente en la página o páginas web de terceros. Por lo tanto, Trend Actually no responderá, bajo ninguna circunstancia, de la legalidad de los contenidos de dicha/s página/s, siendo responsabilidad exclusiva del tercero todo lo que concierna al contenido de ese enlace, especialmente el respeto a la ley, moral, buenas costumbres y orden público. La existencia de enlaces no presupone relación de ninguna clase entre Trend Actually y el propietario de la página web en que el mismo se establezca.
9. EXONERACIÓN DE RESPONSABILIDAD
Trend Actually se exonera de toda responsabilidad relativa a:
(i) El funcionamiento del Sitio Web, incluyendo causas de fuerza mayor, o cualesquiera otras ajenas a la voluntad de Trend Actually, que no se encuentre totalmente operativo, o carezca eventualmente de la funcionalidad mínima para gestionar el servicio pertinente.
(ii) Los posibles errores o deficiencias de seguridad que pudieran producirse por la utilización, por parte de los Usuarios, de un navegador de una versión no actualizada o insegura, así como por la activación de los dispositivos de conservación de contraseñas o códigos de identificación del Usuario registrado en el navegador o de los daños, errores o inexactitudes que pudieran derivarse del mal funcionamiento del mismo.
(iii) Por los daños y perjuicios directos o indirectos que pudiera causar la información que se transmite o comunique en el Sitio Web o en sus comunicaciones electrónicas incluyendo sin carácter limitativo los errores técnicos o humanos en los datos publicados.
(iv) Los daños, incluyendo entre otros, y sin limitarse a éstos: daños, pérdidas o gastos directos o indirectos, inherentes o consecuentes, que surjan en relación con este Sitio Web o su uso o imposibilidad de uso por alguna de las partes, o en relación con cualquier fallo en el rendimiento, error, omisión, interrupción, defecto, demora en la operación o transmisión, virus informáticos o fallos de sistema o línea.
El Usuario responderá por los daños y perjuicios de cualquier naturaleza por actos ilícitos o fraudulentos así como aquellos daños o perjuicios que Trend Actually o sus Usuarios pudieran sufrir como consecuencia, directa o indirecta, del incumplimiento por parte del Usuario de las presentes Condiciones de Uso, reservándose Trend Actually aquellas acciones a las que tuviera derecho ante las autoridades judiciales o policiales pertinentes.
Aunque emplea sus mayores esfuerzos, Trend Actually no puede garantizar a los Usuarios el acceso y uso continuado e ininterrumpido de su Sitio Web.
10. MODIFICACIONES
Trend Actually tiene derecho a revisar y modificar en cualquier momento las presentes Condiciones de Uso. El Usuario estará sujeto a las mismas en el momento en el que las acepte, salvo que por ley o decisión de organismos gubernamentales Trend Actually deba realizar cambios con carácter retroactivo, en cuyo caso los posibles cambios afectarán también a los Pedidos que el Usuario hubiera solicitado previamente.
11. CONTACTO Y COMUNICACIONES POR ESCRITO
La normativa aplicable exige que parte de la información o comunicaciones que Trend Actually envíe al Usuario sea por escrito. Al aceptar las presentes Condiciones de Uso, el Usuario acepta que la mayor parte de las comunicaciones con Trend Actually sean electrónicas. Trend Actually se pondrá en contacto con el Usuario a través de correo electrónico o colgando avisos en el Sitio Web. El Usuario consiente en usar este medio electrónico de comunicación y reconoce que toda notificación, información y demás comunicaciones que Trend Actually le envíe de forma electrónica cumplen con los requisitos legales de ser por escrito.
Para cualquier consulta o incidencia relacionada con los Pedidos, el Usuario deberá ponerse en contacto con Trend Actually enviando un correo electrónico a la siguiente dirección mariatavera@trendactually.es
12. JURISDICCIÓN Y LEY APLICABLE
El funcionamiento y utilización del Sitio Web y de las presentes Condiciones de Uso se rigen por la legislación española. En la medida en que así lo permita la ley, Trend Actually y el Usuario, con renuncia expresa a cualquier otro fuero que pudiera corresponderles, acuerdan someterse a la jurisdicción de los Juzgados y Tribunales de Granada (España).

Terms and conditions

1. GENERAL INFORMATION
These terms of use (the “Terms of Use”) govern access to and use of the website hosted under the domain name www.trendactually.es (the “Web Site”) and under any of the subdomains thereof or its dependent webpages, as well as the content and services that the owner of the Web Site makes available to its users (the “Users”) and set out with the Privacy Policy and Cookies Policies, relating to the management of the Users’ personal data, the terms and conditions governing the Web Site.

2. OBJECT OF THE CONTRACT 
These Terms of Use constitute the entire agreement which regulates the conditions governing the purchase of products made available to the Users by TREND ACTUALLY on the Web Site (the “Products”).
Access to the Web Site or its use by the User, as well as the purchase of any Product, necessarily implies, and without reservation, the knowledge and acceptance of these Terms of Use, and as such it is recommended that the User reads them carefully each time s/he wishes to buy a Product.
3. PRODUCT PURCHASE
3.1 How to buy Products
In order to order Products, the User must follow the purchasing procedure set out on the Web Site, read and accept the Terms of Use and select “Finish and Pay” (the “Order”). Then TREND ACTUALLY will email the User to confirm that the Order has been accepted (the “Order Confirmation”). The contract between the User and TREND ACTUALLY will be definitely formalized once TREND ACTUALLY sends the User a Order Confirmation. Only those products listed in the Order will be covered by the contract.
3.2 Availability of Products
All Orders are subject to availability of Products. In the event that, once the Order Confirmation is sent, TREND ACTUALLY cannot provide the requested Product for any reason, it will contact the User as soon as possible in order to report this circumstance. In this case, TREND ACTUALLY may:
(i) offer the User, with no increase in price, a product of similar characteristics and features to the one originally requested, provided they are consistent with the needs of the User; and/or
(ii) offer the User to cancel the requested Order, refunding the amount paid within (14) business days.
3.3 Refusal to process an Order
Although TREND ACTUALLY will always endeavour to process all Orders, there may be exceptional circumstances in which it may be forced to refuse to process an Order after having sent the Order Confirmation, and TREND ACTUALLY reserves the right to do this at any time at its sole discretion. 
TREND ACTUALLY reserves the right to withdraw any Product from the Web Site at any time and to remove or modify any materials or content, and shall not be liable to the User or to any third party as a result of withdrawing any Product from the Web Site, regardless of whether said Product has been sold or not, or as a result of removing or modifying any materials or content on the Web Site.
3.4 Product Warranty
All Products contained on the Web Site are original TREND ACTUALLY products. All Products have a 2-year warranty in accordance with the criteria and conditions described in Legislative Royal Decree 1/2007, of 16 November, approving the consolidated General Act on Consumer and User Protection and other complementary laws.
The Products shall be deemed comply with the Terms of Use provided that they meet all of the requirements set forth below:
(i) They adhere to the description given by TREND ACTUALLY and possess the qualities of the Product that TREND ACTUALLY has presented to the User as a sample or model.
(ii) They are suitable for the uses normally given to Products of the same type.
(iii) They are suitable for any particular purpose required by the User when this has been reported to TREND ACTUALLY, provided that TREND ACTUALLY has accepted that the product is suitable for such use.
(iv) They have the usual quality and performance of a product of the same type that may be expected by the User, given the nature of the item.
In the event of proven Product nonconformity with the required specifications, TREND ACTUALLY shall where appropriate, repair, replace, reduce the price or terminate the contract, at no cost for the User.
TREND ACTUALLY shall not be liable for damage to the Products that may result from misuse thereof or from actions or omissions of the User that do not conform to the specifications of each Product, or for damage caused by third parties not related to TREND ACTUALLY.
TREND ACTUALLY puts great care in the presentation and description of the Products. However, the photographs of the products are presented by way of illustration. For information on the precise characteristics of each Product, the User must check the description accompanying each Product.
3.5 Delivery of Products
Once the Order Confirmation is sent, the Products will be delivered to the address specified by the User when making the Order within approximately one to seven (1-7) working days from when they leave the warehouse of TREND ACTUALLY.
TREND ACTUALLY assumes no liability where the Product is not delivered due to the fact that the data provided by the User is false, inaccurate or incomplete or if delivery cannot be completed through no fault of the shipping company used for this purpose, like the absence of User or the retention of the Product by Customs.
Delivery times are approximate, although TREND ACTUALLY tries to meet them.
3.6 Delivery costs
Delivery costs include transport, insurance and customs at source. For delivery to countries not part of the EU, customs charges at destination and other taxes (duties)are not included; the recipient will have to settle these in cash in order to receive the merchandise. 

The recipient shall be required to pay all import costs and custom duties at the destination, regardless of whether or not the merchandise is accepted. 

The goods will be dispatched in the shortest time possible; however, the recipient should take into account the import procedures of the destination country, for which TREND ACTUALLY cannot be held responsible. Neither shall TREND ACTUALLY accept any liability for delays caused by strikes, armed conflicts or other circumstances beyond its control. 

TREND ACTUALLY does not accept any liability for delays due to customs procedures or in the event that the local authorities decide to confiscate any part of the order.
3.7 Price and payment of the Products
The prices applicable to each Product will be those published on the Web Site on the date on which the Order is placed by the User. Although TREND ACTUALLY tries to ensure that all prices listed on the Web Site are accurate, errors may occur. In the event that TREND ACTUALLY discovers an error in the price of any of the Products that a User has requested, it will inform the User as soon as possible and give him/her the option of reconfirming the order at the correct price or cancelling it. If TREND ACTUALLY fails to contact the User, the order will be considered cancelled and the User shall be fully refunded any amounts paid.
TREND ACTUALLY shall not be required to provide the User with any Product at an incorrect lower price (even if the Order Confirmation has been sent) if the pricing error is obvious and unmistakeable and could be reasonably recognized by the User as an incorrect price.
The prices may change at any time. However, any changes will not affect the Products with respect to which TREND ACTUALLY has already sent a Order Confirmation.
a) Form of payment
Users may pay by credit card or Visa debit, Visa Electron, MasterCard, American Express or PayPal. To minimize the risk of unauthorized access, the User's credit card details will be coded. Both if the payment is made by credit or debit card or through PayPal, the charge will be made at the time when TREND ACTUALLY sends the Order Confirmation to the User.
b) Value Added Tax (VAT)
The VAT rate will be the legally applicable rate at each time depending on the particular product.
4. RETURN AND EXCHANGE POLICY
a) Right of withdrawal
Under applicable regulations, in the event that the User is contracting as a consumer, s/he may cancel the contract (except for the cases established by law) and freely return or change the delivered Products at any time within fourteen (14) calendar days from the date of delivery (the “Withdrawal Period”).
In case the User want to enforce such right, s/he shall contact TREND ACTUALLY at the e-mail address mariatavera@trendactually.es to manage the return. The User will get a RETURN NUMBER back, and then s/he can choose among shipping the returned goods her/himself or letting TREND ACTUALLY manage the shipping.
Once the returned Product has been inspected to verify compliance with the requirements of section c) below, and in the case that the User decides not to exchange the Product, TREND ACTUALLY shall refund the User the amount paid for Product, excluding shipping expenses which will be paid by the User in accordance with the table below:

Upon expiry of the Withdrawal Period, no Product exchanges or returns will be accepted. Product exchanges will only be accepted for defective products in accordance with the provisions of section b) below. 
b) Return of defective Products
In the event that the User considers that the Product does not conform to the Product’s specifications, the User shall immediately contact TREND ACTUALLY at the e-mail address mariatavera@trendactually.es with details of the Product and the defect and specifying whether s/he chooses to return the Product or to exchange it for an identical Product.
The User may return the Products at the place where they were delivered to a courier which will be sent by TREND ACTUALLY or return the Product using his or her own means. Once the returned product has been inspected, TREND ACTUALLY will send within a reasonable time, an email informing the User whether the Product will be refunded or replaced (the “Refund or Exchange Decision”). In that case, the Product will be refunded or exchanged as soon as possible and in any event within fourteen (14) days following the date on which the Refund or Exchange Decision was sent.
In the event of a refund or exchange of a Product, TREND ACTUALLY shall fully refund the price of the Product to the User, including shipping expenses. In terms of the watches, up to 1 month from the purchase, TREND ACTUALLY will replace the faulty watch for a new model. TREND ACTUALLY will be responsible for the costs of collection and delivery in this occasion.
After a month of the purchase, the user is given the option of repairing the watch. In this case, the user will be in charge of the shipping costs towards the repairing service. Once the watch has been repaired, TREND ACTUALLY will resend it to the recipient running with the shipping costs.
The repairing time of the watches is 1 month since the watch is received. In order to proceed with the replacement or repairing of the watch, the user should contact TREND ACTUALLY through an email to the contact address mariatavera@trendactually.es, reporting the defect, the fault and the order number. 
c) Common provisions for returns
The User shall comply with the following requirements to exercise the right of withdrawal and to make returns and exchanges of Products:
(i) To arrange collection of the Product, the User must first contact TREND ACTUALLY by email at the following address: mariatavera@trendactually.es;
(ii) The User may evidence his or her right of withdrawal in any manner permitted by law; such right shall in any case be deemed to have been validly exercised by returning the Product;
(iii) The Product must be returned in the same condition in which it was received. TREND ACTUALLY shall not refund any amount if the product has been damaged, so the User must be careful with the Product while in his or her possession; and
(iv) The refund will be made by using the same form of payment as used to pay for the Product.
5. USE OF THE WEBSITE 
The Users agree to use the Web Site in accordance with the law, morality, generally accepted good customs and public policy. The Users undertake to refrain from using the Web Site for illegal purposes inconsistent with the provisions of these Terms of Use, or in any other way that may be harmful to the rights and interests of TREND ACTUALLY or of third parties, or damage or harm the image or reputation of TREND ACTUALLY or prevent the normal use of the products and services offered by TREND ACTUALLY on the Web Site.
6. INTELLECTUAL PROPERTY 
All information contained on the Web Site, including its graphic design and source code, are protected by copyright and other rights contained in Legislative Royal Decree 1/1996, of 12 April, approving the Consolidated Intellectual Property Act and other rules governing intellectual property.
These rights belong exclusively to TREND ACTUALLY, and as such any reproduction, distribution, transformation or public communication is expressly prohibited, as well as any transfer of all or part of the contents of the Web Site, and in general any act of exploitation of all or part of the contents (images, text, design, indexes, forms, etc..), as well as the databases and software necessary for the visualization or the functioning thereof and any object that under current legislation is protectable by intellectual property regulations.
The Users may not under any circumstances commercially exploit or use, directly or indirectly, in whole or in part, any content of the Web Site without the prior written consent of TREND ACTUALLY.
The authorization for the use of any content of the Web Site can be requested by writing to the e-mail address mariatavera@trendactually.es . The provisions of the preceding paragraphs will not under any circumstances mean that TREND ACTUALLY assumes any liability for the content, and shall not entitle the Users or any third parties to any compensation.
7. INDUSTRIAL PROPERTY 
The trademarks, trade names, signs, names, logos, slogans or any kind of distinctive sign displayed on the Web Site belonging to TREND ACTUALLY, and very specifically, the word “TREND ACTUALLY” may not be used without the prior written consent of TREND ACTUALLY 
8. LINKS TO THIRD PARTY WEBSITES 
The links contained in the Web Site, referring to publicity or other types of content, and whose ownership or responsibility corresponds to third parties other than TREND ACTUALLY, are not the responsibility of TREND ACTUALLY, which shall under no circumstances undertake to monitor or approve the services, content, data, files, products and other material on the third party webpage or webpages. Therefore, TREND ACTUALLY shall not under any circumstances be liable for the lawfulness of the content of such webpage(s), and the third party is exclusively responsible for all matters concerning the content of that link, particularly for compliance with applicable law, morality, good customs and public policy. The existence of links does not imply any relationship between TREND ACTUALLY and the owner of the website to which the link is directed.
9. DISCLAIMER 
TREND ACTUALLY disclaims all liability for:
(i) The functioning of the Web Site, including cases of force majeure and any other cases beyond TREND ACTUALLY’s control, which is not fully operational, or possibly lacks the minimum functionality for managing the relevant service.
(ii) Any errors or security deficiencies that may arise from the use, by the Users, of an outdated browser or insecure version, as well as the activation of password or identification code conservation devices of the User recorded in the browser or for the damage, errors or inaccuracies that may result from any malfunction.
(iii) For any direct or indirect damages that may be caused by the information transmitted or communicated on the Web Site or in any electronic communications, including without limitation technical or human errors in the published data.
(iv) Damage, including but not limited to damage, loss or direct, indirect, incidental or consequential expenses arising in connection with this Web Site or the use of this Web Site or inability to use the Web Site by any party, or in connection with any failure in performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure.
The User will be liable for all damage and loss caused by wrongful or fraudulent acts as well as for the damage caused to TREND ACTUALLY or its Users as a direct or indirect consequence of a breach by the User of these Terms of Use. TREND ACTUALLY reserves the right to take any actions to which it may be entitled before the relevant law enforcement agencies or courts.
Although it uses its best efforts, TREND ACTUALLY cannot guarantee the Users access and continuous and uninterrupted use of the Web Site.
10. AMENDMENTS 
TREND ACTUALLY has the right to review and amend these Terms of Use at any time. The User shall be subject to these Terms of Use from the time when accepted by him/her, unless any amendments are required with retroactive effects by operation of law or by decision of a governmental authority, in which case such amendments will apply to Orders already placed by User.
11. CONTACT AND WRITTEN COMMUNICATIONS 
Applicable law requires that some of the information and communications to be sent by TREND ACTUALLY to the User must be in writing. By accepting these Terms of Use, the User agrees that most communications with TREND ACTUALLY will be electronic. TREND ACTUALLY will contact the user by email or by notices published on the Web Site. The User agrees to this electronic means of communication and acknowledges that any notice, information and other communications sent by TREND ACTUALLY by electronic means complies with the legal requirement of being in writing.

12. APPLICABLE LAW AND JURISDICTION 
The operation and use of the Web Site and these Terms of Use are governed by Spanish law. Insofar as permitted by law, TREND ACTUALLY and the User, expressly waiving any other jurisdiction to which they may be entitled, hereby agree to submit to the jurisdiction of the courts of Granada, Spain.
